If you are injured while a passenger in a rideshare vehicle, generally I have good news – at least from a legal point of view. That is because, there are several different pools of money you can claim to cover your injuries, losses and pain and suffering.
Now the bad news: it can be complicated to collect.
Here is how it works. There are typically 3 piles of money — the driver has his or her own insurance, the rideshare company covers each accident up to an additional million dollars (required by the State of Alabama) and you may be able to collect from your own insurance company.
Now the tricky part. The driver may have the minimum personal insurance and that might not be enough. The rideshare company has restrictions on their money including individual amounts and whether the driver is logged into the company’s app (many drivers work for multiple companies). And to make it even more confusing, you may be able to sue your own insurance company under your own policy.
Here is my strong advice. If you are hurt while using a rideshare, call a personal injury attorney. We are used to juggling these types of issues. It has been my experience that if you try to go it alone, you will never get top dollar. It is just too hard.
Some other advice. Get medical help even if you don’t, at first, think you are seriously hurt. It is best to let a professional evaluate your injury.
