What is Personal Injury?

If you are injured in Alabama, you can get money for your pain and suffering. It is part of the law that some applaud for helping injured folk and others condemn as the “catch all” for those trying to lie, cheat and manipulate their way into money they do not deserve.

It has been my experience that people who think pain and suffering payments are wrong are often people who have never been injured. Injured folk, like my clients, know there is real disruption after an accident. Here are some possible examples: you can’t take the kids to school or attend their football games, your sleep is severely disrupted, you have to have someone else brush your teeth, you can’t contribute to your mother’s nursing home bill, you can’t get a glass out of a cabinet, you feel worthless. All of this can be caused by someone else’s action, and if so, you deserve to have the money to make it right.

Now add the biggest disruption of all. Pain. Just how much is the pain you endure worth? I would guess that most of my clients would give back all the money they collected; if they would not have to endure the excruciating pain of recovery.

Alabama does not set an amount for pain and suffering. It is left to a jury or what an insurance company thinks a jury would decide. Here is the part that might shock you. Pain and suffering is so common that those in the legal business never seem to question that it actually exists. They fight only on the severity.
