A friend asked me why so many advertising attorneys were saying they will make having a legal case easy. I told her if they go easy; then, they are settling for too little money. A good attorney knows you must work hard for those big payouts.
Here is how it works: If you are willing to settle cheaply then the insurance company is willing to settle quickly. Big money payouts are almost always because it will cost too much time and money to fight the case. In short, a jury would step in and give you a big wad of cash.
I have had a number of cases where the insurance company offered a hurt person several hundred dollars, and I was able to get them many thousands of dollars. Most every good attorney has had similar instances.
Here are the big things to look out for:
- If you are told you don’t need an attorney, you probably need one and fast.
- It doesn’t cost anything to see most personal injury attorneys. Go see an attorney before you sign anything with an insurance company.
- No case is too small. If for some reason you are turned down by an attorney, go see another. Stories of cases turned down several times that then led to six and seven figure settlements are almost common.
Now the reality is you will probably never have to go to court. But if your lawyer is perceived as afraid to fight for your case to the fullest, an insurance company will lower what they offer.
