The pandemic is frightening many Gulf Coast people from trying to collect the money owed them after being hurt at a business or someone’s home.
These concerns have hit a particular type of injury law — what we call “slip and fall.” Some examples are when a person trips on a recently washed restaurant floor or tumbles off a neighbor’s porch when the railing breaks.
I appreciate you don’t want to unduly go after a business that has hit hard times. However, here is what you need to know. Though in Alabama you must technically sue the business or homeowner, you are most often fighting with an insurance company. Most every business and property owner have insurance to cover these unforeseen events.
Why don’t you know about this? In our state, not only can you not sue the insurance company directly … but to make matter worse, you cannot even tell a jury or judge that insurance is involved.
My partner, Bill Eiland, specializes in slip and fall injuries. These cases can be difficult to win and often requires in-depth investigations. My advice is to make sure your attorney has extensive experience in this specific type of law.
